Terms of Service

1. ACCEPTANCE OF TERMS

By accessing or using PAGATracker.com (the "Site") and any data, content, features, or services provided through the Site (collectively, the "Services"), you agree to be bound by these Terms of Service ("Terms"). If you do not agree, do not use the Services.

2. DEFINITIONS

"PAGA Tracker," "we," "our," and "us" refer to PAGATracker.com. "You" and "your" refer to the individual or entity that accesses or uses the Services. "Content" means all text, data, reports, images, graphics, software, and other materials made available through the Services.

3. GRANT OF LIMITED LICENSE AND USE RESTRICTIONS

We grant you a non-exclusive, non-transferable, revocable, limited license to access and use the Services for your own internal, non-commercial purposes, subject to these Terms. You may not:

• Sell, resell, sublicense, or otherwise exploit the Services or Content for commercial redistribution;
• Use any automated means (bots, scrapers, spiders) to access or collect data from the Services;
• Interfere with or damage the Site or its security;
• Remove proprietary notices, trademarks, or other legends from the Content;
• Use the Services in any manner that violates applicable law or infringes any third-party right.

4. ACCOUNT REGISTRATION AND SECURITY

Optional user accounts are provided solely to the individual who registers. You are responsible for maintaining the confidentiality of your login credentials and for all activities that occur under your account. Notify us immediately of any unauthorized use. We may suspend or terminate accounts that violate these Terms or present a security risk.

You agree to provide accurate account information and to keep it current. You are responsible for all activity under your account, including activity by authorized users within your organization.

5. NO LEGAL ADVICE

The Services provide access to public court filings, government documents, and other legal information for research and informational purposes only. PAGA Tracker is not a law firm; no attorney-client relationship is created. The Content is not legal advice and should not be relied on as such. You should consult a qualified attorney for legal advice.

6. DATA ACCURACY AND DISCLAIMER

The Content is collected from third-party sources, including courts and government agencies. We do not warrant that the Content is complete, current, or free of errors. Records may be incomplete, out of date, or inaccurately transcribed. Your use of any Content is at your own risk.

You may submit error reports or redaction requests for review. PAGA Tracker may, in its sole discretion, approve, deny, or condition any request. Nothing in these Terms requires us to remove, alter, or de-index content absent a legal obligation (such as a valid court order).

7. INTELLECTUAL PROPERTY

All right, title, and interest in the Services and Content, including all copyrights, trademarks, and other intellectual-property rights, remain with PAGA Tracker or its licensors. Except for the limited license granted in Section 3, no rights are transferred to you.

8. PROHIBITED DETERMINATIONS

You may not use the Services or Content to determine any individual's eligibility for consumer credit, insurance, employment, housing, or any other purpose covered by the United States Fair Credit Reporting Act or similar laws.

9. MODIFICATIONS, AVAILABILITY, UPDATES, AND PAID PLANS

We may add, modify, suspend, or discontinue all or part of the Services at any time without notice. We may update these Terms by posting a revised version. Continued use of the Services after changes become effective constitutes acceptance of the new Terms.

Certain features are available only through paid subscriptions (for example, Lite or Pro plans). Paid subscriptions are processed by Stripe and may renew automatically on a recurring basis until canceled. By purchasing a paid plan, you authorize the applicable recurring charges and any taxes.

You can manage or cancel your subscription through the billing portal available from your account. Unless otherwise stated at checkout, plan changes or cancellations take effect at the end of the current billing period. Except where required by law, fees paid are non-refundable and non-creditable for partial billing periods.

We may change subscription pricing, plan features, or billing terms from time to time. Material changes will apply prospectively.

10. DISCLAIMER OF WARRANTIES

THE SERVICES AND CONTENT ARE PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO WARRANTIES OF ACCURACY, COMPLETENESS, MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, OR NON-INFRINGEMENT. WE DO NOT WARRANT THAT THE SERVICES WILL BE ERROR-FREE OR UNINTERRUPTED.

11. LIMITATION OF LIABILITY

TO THE MAXIMUM EXTENT PERMITTED BY LAW, PAGA TRACKER SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS OR DATA, ARISING OUT OF OR IN CONNECTION WITH THE USE OR INABILITY TO USE THE SERVICES, EVEN IF WE HAVE BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES. OUR AGGREGATE LIABILITY FOR ANY CLAIM RELATING TO THE SERVICES SHALL NOT EXCEED ONE HUNDRED U.S. DOLLARS (US$100).

12. INDEMNIFICATION

You agree to indemnify, defend, and hold harmless PAGA Tracker, its affiliates, officers, employees, and agents from and against any claims, liabilities, damages, losses, and expenses (including reasonable attorneys' fees) arising out of or related to your use of the Services or violation of these Terms.

13. TERMINATION

We may suspend or terminate your access to the Services at any time, with or without notice, for any reason, including violation of these Terms, suspected abuse, or non-payment of applicable fees. Sections 5, 6, 7, 10, 11, 12, and 15 survive termination.

14. GOVERNING LAW AND VENUE

These Terms are governed by the laws of the State of California without regard to conflict-of-law principles. Any dispute arising from these Terms shall be resolved exclusively in the state or federal courts located in Los Angeles County, California, and you consent to their jurisdiction.

15. MISCELLANEOUS

These Terms constitute the entire agreement between you and PAGA Tracker regarding the Services and supersede all prior or contemporaneous agreements. If any provision is held invalid, the remaining provisions remain in full force. No waiver by either party of any breach or default is a waiver of any subsequent breach or default. You may not assign these Terms without our prior written consent; we may assign these Terms without restriction.

Your use of the Services is also subject to our Privacy Policy.
